FINKU – TERMS AND CONDITIONS OF SERVICE
These terms and conditions govern your terms of use (“Terms and Conditions”) before you access and use the Finku Application (“Application”). These Terms and Conditions are for Applications owned and operated by PT. Sahabat Finansial Kamu – a company duly established under the laws of the Republic of Indonesia, referred to as "Company", "we", “us", or “ours").
By using or accessing the Application or any other service provided by us, you hereby agree to be bound by these Terms and Conditions. These Terms and Conditions tell you everything you need to know about the Application and us contained in the Application.
Your Account Registration
You can only use the Application after you have registered for your account and it is declared complete. You acknowledge that the Application will not be available to you without registration. You can add information about yourself to the account in accordance with the minimum information required by us in the Application.You must commit to the age restriction for registering an account, namely you must be at least 18 years old, and guarantee the truth of the information you provide.If you are under 18 years of age, you must and we consider to have obtained permission from one of your parents or legal guardians to register an account. We urge you not to create an account until you have asked your parent or legal guardian for approval.If you are the parent or legal guardian of a minor who wishes to create an account, you must agree to these Terms and Conditions on behalf of the minor, and you are responsible for all use of the account or Application services.
Application Usage
You must use the Application only in accordance with these Terms and Conditions, for the intended purpose and comply with all applicable regulations and laws and third party terms of use.
Application License
The Application Services provided by us to you are governed by your compliance as a licensee (“Licensee”) with responsibilities defined as follows:
You are fully responsible for maintaining the confidentiality and security of access information that you use to access the service (as further explained and defined in the General Terms of Service), including but not limited to access numbers, passwords, security questions and answers, account numbers, and/or login information (collectively, "Access Licensee Information").
You are solely responsible for ensuring that your use of the Application services does not violate any applicable Terms and Conditions, policies, guidelines, regulations or restrictions of your financial services provider. You hereby acknowledge and agree that you are solely responsible for verifying the compliance of the Application services with the terms and conditions, policies, guidelines, regulations or restrictions of your financial service provider and we expressly disclaim any liability resulting from your failure to do so.
You are solely responsible for all electronic communications, including account registration and other account holder information, email, financial data, and other data entered using Licensee Information Access. Company assumes that any communications received through the use of Licensee Information Access are sent or authorized by you and that any communications you send comply with applicable law.
You hereby agree to immediately notify us if you become aware of any loss, theft, or unauthorized use of Licensee Access Information. We reserve the right to deny access to the service (or any part thereof) if we reasonably believe that loss, theft, or unauthorized use of Licensee Access Information has occurred to enable us to investigate the loss, theft, or any unauthorized use of Access Licensee Information.
You hereby acknowledge and agree that we and related third parties have permission to combine data in your account from your Financial Service Provider such as bank and credit card, debit and deposit fees ("Account Data") with data from others in a manner that does not identify you or any individual, and to use such aggregate Account Data to conduct certain analytical research, performance tracking and comparisons, and publish summary or aggregate results from time to time, and distribute or license anonymous, aggregated research data for any purpose, including but not limited to helping improve products and services, assisting with troubleshooting, and technical support.
Third Parties and Our Applications
We may have material on the Application that is provided by third parties. In connection with your use of the Application, or any other services provided in connection therewith, you may be informed about services offered by third parties including online banking, online payments, online investments, account downloads, online bill payments, online trading, and other accounts information available from your third party Financial Services Provider ("Provider") (such services are collectively referred to here as "Third Party Services").
If you decide to use Third Party Services, including but not limited to setting up banking, scheduling services to access your account, and/or downloading transactions, you are solely responsible for reviewing and understanding the terms and conditions governing such Third Party Services. Under no circumstances will we be responsible for the delivery of Third Party Services, the information contained on such third party websites or for your use of or inability to use Third Party Services or access your account, obtain data or download transactions. Access to any third party websites is at your own risk, and you acknowledge and understand that linked third party websites may contain terms and privacy policies that differ from ours and over which we have no input or control. You hereby understand that we expressly cannot accept and disclaim any responsibility or guarantee for the accuracy and performance of such Third Party Services.
Application Changes and Suspensions
We have the discretion to change or discontinue, temporarily or permanently, the Application services including for technical reasons, security issues, and legal requirements by providing reasonable prior notice to you. However, in certain circumstances, we may not be able to notify you in advance. We will not be liable for any changes, suspension, or discontinuance of services.
Modifications may include establishing or changing limitations regarding use of the service, temporary or permanent, including (i) the amount of storage space you have on the service at any time and (ii) the number of times (maximum duration) you may access the service in a given time period. We will endeavor to provide notice of any changes to these End User License Terms thirty (30) days prior to such modification. Therefore, we recommend that you review these Terms and Conditions from time to time. Your continued use of the Application and services available after the Company's notification of modifications to these Terms and Conditions constitutes your agreement to the Terms and Conditions that have been changed or modified. We can do maintenance services on the Application from time to time which may result in interruptions, delays, or errors in service.
Disclaimer
The Application, its content, services, and links are provided on an “As Is” basis and are used at your own risk. You are solely responsible for any damage to your computer system, application, or other device or loss of data resulting from the use of the service, Third Party Services, or data provided through the service or Third Party Services to the extent permitted by law. We disclaim all warranties, express, implied, or statutory of any kind regarding this Application (including its content, services, software, hardware, and third party links) including any implied warranties of fitness for a particular purpose, merchantability, title, non-infringement, results, accuracy, completeness, accessibility, compatibility, legality, security, error-free, and non-interfering. If applicable laws and regulations do not allow the exclusion of some or all of the above implied warranties to apply to you, the above exclusions will apply to you to the maximum extent permitted by applicable law.
Limitation of Our Liability
Your use of the Application is at your own responsibility and risk. You expressly understand and agree that we or our directors, employees, partners, agents, or affiliates are not responsible for any direct or indirect, incidental, special, consequential, or punitive damages and losses, including without limitation, loss of profits, data, use, goodwill, or other intangible or tangible losses, resulting from these Terms and Conditions, use of the Application, or our actions in connection with the service. Moreover, we are not responsible for any damage or loss to you caused by (a) improper use of the Application; (b) any third party content and services on the Application; and/or (c) unauthorized access to or alteration of your transmissions or data.

Language
These Terms and Conditions are made in Indonesian and English. In the event of any inconsistency or difference in interpretation between the Indonesian version and the English version, you agree that the Indonesian version shall prevail to the extent of such inconsistency or difference, and the relevant English version is deemed to be automatically modified to conform to the relevant portion of the Indonesian version.
FINKU - Privacy Policy
Finku ("We") respects the privacy of our users ("Users" or "You"). This Privacy Policy explains how we collect, manage, use, disclose, and protect the information we obtain from you when you access and use services within the Finku application ("Finku App"). We expect you to read this Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access or use the Finku App.
We have the discretion to make changes to this Privacy Policy at any time and for any reason. Upon such changes, we will notify you of any changes by updating the "Last Updated" date on this Privacy Policy. Any changes and/or modifications will be effective immediately upon us posting the updated Privacy Policy on the App, and you waive the right to receive specific notice of each such change or modification.
We suggest you review this Privacy Policy periodically to stay informed of any updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in the updated Privacy Policy by continuing to access and use the Finku App after the updated Privacy Policy's effective date is displayed in the Finku App.
Your use of the Finku App or any of our Services (as outlined in the Terms of Use) is subject to this Privacy Policy and constitutes your explicit agreement to this Privacy Policy.
- About Us and Our Services
The Finku App is designed to help you track and analyze your financial records automatically or manually by inputting your transactions into the Finku App. You can also perform automatic synchronization with your bank accounts and/or digital wallets. Based on these records and synchronizations, the Finku App will provide graphs, summary information, and financial advice (hereinafter referred to as the "Services").
- Information We Collect
We may collect information about you in various ways. We use Personal Data in a limited and specific manner, lawfully, and transparently.To open and maintain your Account in the Finku App, information you provide to us may include:
- Personal Data: Personal identifiable information, such as name, email address, phone number, copies of identification cards (Identity Card, Passport, Driver's License, and/or other identification cards), your selfie, and demographic information, such as gender, and including but not limited to personal financial data such as e-Statement OCR, that you voluntarily provide to us when you register and create your account before using the Finku Application or when you choose to use specific features available in the Finku Application or when you choose to participate in various activities related to the Finku Application, such as online chats and message boards, as well as subscribing to newsletters and promotional emails. You are not obligated to provide us with any personal information in any form, but your refusal to do so may prevent you from using certain features of this Application.
- Derived Data: The information collected by our server automatically when you access the Finku Application, such as your IP address, browser type, your operating system, your access time, and including but not limited to the pages you have directly viewed before and after accessing the Finku Application. This information may also include your device name and type, your operating system, your telephone number, your country, and other interactions with the application and other users through server log files, as well as any other information you choose to provide.
- Mobile Device Data: Device information, such as your operating system, your wifi/cellular connection usage, your battery level percentage, your mobile device type, your device ID, model, and manufacturer, and including but not limited to information about your device's location if you access the Finku app or our site from a mobile device to, among other things, detect your location. We may access the Camera and Audio on Users' mobile devices so that we can provide Services to be provided to you, including for identity verification purposes.
- When you use the Finku App to analyze and track your finances, your transaction data will be stored on our servers including information about income, expenses, categories, amounts of money, types of expenses and income, transaction date and time details, and other information provided by you.
To avoid doubt, if you use the Services and request us to provide you with account information services connected or associated with your bank account, you hereby explicitly consent to be bound by our Terms of Service and third-party license or terms of service (as applicable and as will be notified to you). All of your Personal Information provided in connection with or accessed during your participation in such bank connection features will be processed only to provide you with account information services. Your Account Information and all other Personal Data accessed through the bank connection feature will be transmitted by us through secure and encrypted protocols. When your Account is connected to the bank connection feature, we will ensure to maintain the confidentiality and provide adequate protection levels for your Account Information and all other Personal Data we process related to the provision of bank connection feature services. For the avoidance of doubt, this Information will be made in such a way that it cannot be read by us and we will not provide or operate bank connection features without your consent.
We reserve the right to combine the data we obtain from these sources with other data we own for Personal Data processing. Personal Data will be stored by us for a period specified in accordance with applicable laws and regulations. After the retention period expires, we will delete or anonymize User Personal Data.
- Where we store your information we collect
Information we collect from you or related to you will be transferred and stored within the territory of the Republic of Indonesia by us and/or Third Parties working on our instructions. In this regard, we will make all reasonable efforts to ensure that all such Third Parties concerned can accommodate proper protection and comply with the commitments we make based on this Privacy Policy, and comply with the provisions of the applicable laws and regulations in the Republic of Indonesia.
If we provide you (or if you choose to have) passwords or passcodes that allow you to access certain parts of the Finku App, you are responsible for maintaining the confidentiality of those passwords. We request that you do not share your passwords with others.
- Your Information Usage
We will use the Personal Data we obtain for the purposes stated. Having accurate information about you will enable us to provide you with a smooth, efficient, and personalized experience. Specifically, we may use the information collected about you through the Finku Application to:
- Create and manage your account.
- Provide Services to you according to the Service preferences selected and approved by you.
- Enhance the efficiency and operation of the Finku Application by conducting usage analysis and trends to improve your experience in using the Finku Application.
- Notify you about Finku Application updates.
- Offer Services and/or new recommendations to you and for us to conduct other business activities as needed.
- Conduct business functions and/or operations conducted by Finku and/or its affiliates.
- Prevent fraudulent transactions, monitor all forms of theft, and protect against criminal activities and terrorism financing.
- Collect statistical data and anonymous analysis for internal use or with third parties.
- Send advertisements, coupons, newsletters, and other information about promotions and the Application to you.
- Send emails about your account or orders.
- Enable communication between users.
- Assist you when communicating with Our customer service, including:
- Checking and addressing your issues.
- Directing User inquiries to the appropriate customer service representatives to address issues.
- Monitoring and improving our customer service responses.
- Contacting Users via E-mail, WhatsApp, and Instagram, including but not limited to assisting and/or completing transaction processes or issue resolution processes, and conveying news or other notifications related to the protection of User Personal Data by us, including failures in protecting User Personal Data.
- Using information obtained from Users for research, analysis, development, and testing of products to enhance the security of services on the Finku Application, as well as to develop new features and products.
- Informing Users about products, services, promotions, studies, surveys, news, latest developments, events, and other information, whether through the Finku Application or other media. We may also use this information to promote and process contests and sweepstakes, provide prizes, and present relevant advertisements and content about our services and business partners.
- Validate User requests, activities, and transactions, and enhance approval for the services we provide. We may also use the information we collect to verify User identities, prevent fraud, and evaluate the effectiveness of our marketing strategies.
- Monitor and investigate suspicious transactions or signs of fraud or violations of the Terms and Conditions and applicable legal regulations, and take necessary actions as next steps based on the monitoring or investigation results of these transactions.
- We will send important messages related to our services to Users. Users are aware of and agree that we will contact them via telephone, SMS, email, WhatsApp, or other media to provide support related to the services we provide. If Users decide not to receive communications from us at any time, Users can follow the unsubscribe instructions provided in the communication or contact our customer service.
- In certain situations, we may use or disclose User Personal Data to comply with legal provisions, including national defense and security interests, law enforcement, public interests in state functions, supervision of financial, monetary, payment systems, and financial system stabilization undertaken in the context of state administration, statistical interests and scientific research, including in cases of disputes or legal proceedings between Users and us, or allegations of crimes such as fraud or data theft.
- Comply with the obligations set forth by applicable regulations regarding tax aspects in Indonesia.
- Facilitate merger transactions, company asset sales, consolidations or restructurings, financing or acquisitions involving us.
- Information Disclosure / Information Retention
We may share the information we collect about you in certain situations. Your information may be disclosed as follows:
- Third Party Service Providers: We may share your information with third parties that provide services to us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance, as well as other financial institutions that may be our business partners in relation to providing services in the Finku Application. Marketing Communications: With your consent, or with the opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law.
- Interaction with Other Users: If you interact with other users on the Finku Application or Our site, those users may see your name, profile photo, and activity description, including sending invitations to other users, chatting with other users, liking posts, following blogs.
- Online Posts: When you post comments, contributions, or other content to the Finku Application or Our site, your posts may be visible to all users and may be publicly distributed outside the Finku Application forever.
- Third Party Advertisers: We may use third-party advertising companies to serve ads when you visit the Finku Application or Our site.
- Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
- Business Partners: We may share your information with our business partners to offer you certain products, services, or promotions.
- Based on Law or to Protect Rights: If we believe that releasing information about you is necessary to respond to legal processes, to investigate or remedy potential policy violations, or to protect the rights, property, and safety of others, we may share your information as permitted or required by law, rules, or regulations. This includes exchanging information with other entities for fraud protection and credit risk reduction.
- Tracking Technologies We Use
Cookies and Web Beacons: We may use cookies, web beacons, pixel tracking, and other tracking technologies on the Application to help customize the Application and improve your experience. When you access the Application, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can delete or reject cookies, but be aware that doing so may affect the availability and functionality of the Application. You should not reject web beacons. However, cookies can be made ineffective by rejecting all cookies or by changing your web browser settings to notify you each time a cookie is offered, allowing you to accept or reject cookies individually.
Internet-Based Advertising: Additionally, we may use third-party software to serve ads on the Application, implement email marketing campaigns, and manage other interactive marketing initiatives. These third-party software may use cookies or similar tracking technologies to help manage and optimize your online experience with us. For more information on opting out of interest-based advertising, visit the Network Advertising Initiative Opt-Out Tool or the Digital Advertising Alliance Opt-Out Tool.
Website and Email Analytics: We may also partner with selected third-party vendors, such as Google Analytics and others, to enable tracking technologies and remarketing services on the Finku Application or Our site through the use of first-party and third-party cookies, to, among other things, analyze and track the usage of the Application by users, determine the popularity of certain content, and better understand online activity. By accessing the Application, you agree to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policies and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors. However, if you do not want any information to be collected and used by tracking technologies, you can visit the third-party vendor or the Network Advertising Initiative Opt-Out Tool or the Digital Advertising Alliance Opt-Out Tool.
- Your Rights Regarding Your Personal Data
Right to Access Data
You have the right to request that we provide confirmation to you whether we are processing your Personal Data or not and, if so, provide you access to the Personal Data and the following information: (a) processing purposes; (b) categories of Personal Data concerned; (c) recipients or categories of recipients to whom the Personal Data has been or will be disclosed; (d) if possible, the estimated period for the Personal Data storage, or, if not possible, the criteria used to determine that period; (e) the existence of the right to request from us rectification or erasure of Personal Data or restriction of processing concerning you or to object to such processing; (f) the right to lodge a complaint with a supervisory authority; (g) if the Personal Data is not collected from you, any available information regarding its source; (h) the existence of automated decision-making, including profiling, and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for you. If your data is transferred to a country outside Indonesia, you have the right to be informed about the appropriate safeguards relating to the transfer. If you request so, we will provide you with a copy of your Personal Data being processed by us. For any additional copies you request, we may charge a reasonable fee based on the administrative costs we incur. If you make a request electronically, and unless requested otherwise by you, the information will be provided to you in a commonly used electronic form.
Right to Rectification
You have the right to obtain from us without undue delay the rectification of inaccurate Personal Data concerning you. Taking into account the purposes of processing, you have the right to complete incomplete Personal Data, including by providing a supplementary statement concerning the changes.
Right to ErasureYou have the right to request us to erase your Personal Data without undue delay as regulated in applicable legal regulations. However, deletion of Personal Data will mean that we will not be able to provide you with profitable offers in the future.
- Access and Rectification of Personal Data or Withdrawal of Consent
- We take reasonable steps to ensure that Users' Personal Data is processed accurately, completely, not misleading, up-to-date, and accountable. However, it is important for Users to promptly inform us of any changes to Users' Personal Data or if there are any errors in Users' Personal Data under our control. Users have the right to access or correct Users' Personal Data under our control through our customer service available in this Privacy Policy. However, such requests will only be processed by us if the User has provided adequate proof of identity to access or correct the data. We reserve the right to refuse requests to access, or to correct, some or all of Users' Personal Data under our control if permitted or required by applicable laws and regulations. In cases where the Personal Data may contain references to others or where the request for access or correction is for reasons we deem irrelevant, not serious, or burdensome, we reserve the right to refuse such requests. We do not charge Users with administrative fees to handle User requests related to access or correction of Users' Personal Data.
- Users can withdraw consent provided to us regarding the processing of Users' Personal Data under our control by submitting such request through the channels listed in this Privacy Policy. In the event that such request is approved by us, we will process the User's request within a reasonable time frame from the date the consent withdrawal request is submitted, and thereafter will not process Users' Personal Data according to the User's initial request, unless required by applicable laws and regulations. In the event of withdrawal of consent, we may not be able to fulfill our obligations under any agreement between the User and us. In this regard, there is also a possibility that due to our inability to fulfill our obligations because the User withdraws consent, any legal relationship between the User and us will be terminated and cannot be continued. We will process all requests for withdrawal of consent for the processing of Personal Data within 3 (three) working days from the receipt of such request.
- Security, Storage, and Deletion of Personal Data
- We ensure the protection of every User's Personal Data stored in our system, safeguarding it from unauthorized access, unauthorized disclosure, unauthorized alteration, misuse, destruction, and/or loss of Personal Data through security measures including the use of passwords and OTP (One Time Password) codes by Users.
- User's Personal Data may also be stored or processed outside the Republic of Indonesia by our partnering entities or by third-party service providers, vendors, suppliers, partners, contractors, or affiliates. In such cases, we will ensure that Personal Data remains protected according to the commitments stated in this Privacy Policy.
- Although we have taken the best steps to secure and protect User's Personal Data, it should be noted that data transmission over the internet cannot be fully guaranteed to be secure. By using the Finku Application service, Users acknowledge that they understand the risks that may arise from using the service and transmitting data over the internet.
- We will delete or modify User's Personal Data under our control if (i) the User's Personal Data is no longer necessary for the purposes of data processing; and (ii) storage is no longer necessary to comply with applicable laws and regulations. However, deletion of Personal Data will mean that we will not be able to provide you with profitable offers in the future.
- Please note that there may still be some User's Personal Data stored by others, including authorized state regulatory agencies. If we share User's Personal Data with authorized state regulatory agencies or other agencies designated by the authorized government or cooperating with us, Users agree and acknowledge that the storage of User's Personal Data by such agencies will be subject to the data storage policies of each respective agency.
- Protection of Personal Data Security
The security of your Personal Data information is crucial to us. Finku ensures that collected information is securely stored, however, please note that no method of internet data transmission or electronic storage is entirely secure. Therefore, Finku cannot guarantee 100% security of data provided or transmitted to Finku by you, and the provision of information by you is at your own risk. Our efforts in storing your Personal Data information include:
- Obtaining explicit consent in writing or recorded orally from you to process Personal Data which can be stored and shown as proof;
- Taking customary efforts to protect the security of your Personal Data from unauthorized access, unauthorized disclosure, unauthorized alteration, misuse, destruction, and/or loss of Personal Data.
- Informing the purposes and activities of processing, as well as the failure of protection of your Personal Data.
- Collecting and processing your Personal Data in a limited and specific manner, legally valid, transparent, fair, accountable, and in accordance with its purpose.
- Recording all activities of Personal Data processing.
- Providing written notification to you and relevant authorized agencies within a maximum of 3x24 hours in case of failure of protection of your Personal Data.

- Bahwa terdapat kemungkinan bahwa beberapa Data Pribadi Anda disimpan oleh pihak lain, termasuk instansi penyelenggara negara yang berwenang. Dalam hal Finku membagikan Data Pribadi Anda kepada instansi penyelenggara negara yang berwenang dan/atau instansi lainnya yang dapat ditunjuk oleh pemerintah yang berwenang atau memiliki kerja sama dengan Finku. Anda menyetujui dan mengakui bahwa penyimpanan Data Pribadi Anda oleh instansi tersebut akan mengikuti kebijakan penyimpanan data masing-masing instansi tersebut.
Finku Bersama akan menyelidiki keluhan Anda dan berupaya untuk memberikan tanggapan terhadap keluhan tersebut dalam kurun waktu yang wajar setelah menerima keluhan yang disampaikan oleh Anda.
Jika Anda memiliki kekhawatiran tentang penanganan atau perlakuan Finku terhadap Data Pribadi Anda atau jika Anda yakin bahwa privasinya telah dilanggar. Anda dapat menghubungi Finku melalui layanan pelanggan Finku atau kepada kontak Finku yang tercantum dalam Kebijakan Privasi ini dengan menjelaskan identitas dan sifat keluhan Anda.
- Protection of Personal Data Security
Our services are not intended for children under the age of 18. We will not intentionally collect, use, provide, or process, in any form, any personal information from children under the age of 18.
As a parent and/or legal guardian, please do not give permission for children under your care to submit their Personal Data to us. We will close any accounts used by such children and will remove and/or delete all personal information submitted to us without the consent of the parent or legal guardian of the child under the age of 18.
- Use of Personal Data for Persons with Disabilities
Specifically, we will process the Personal Data of Users who have disabilities, conducted through communication in certain ways according to the needs of persons with disabilities as regulated in Law Number 8 of 2016 concerning Persons with Disabilities.
In processing such data, persons with disabilities may act for and on their own behalf or be represented by a guardian.

- Storage, Subject Data Requests, and Deletion of Personal Data
- We will retain information as long as the User's account is active, in accordance with the requirements set by applicable laws and regulations in Indonesia.
